Penalties for a First Offense Felony
Class 6 Felony with No Priors: The least severe felony. Up to two years in prison; up to three years in prison for a dangerous Class 6 felony.
Class 5 Felony with No Priors: Up to two and one-half years in prison; up to four years in prison for a dangerous Class 5 felony.
Class 4 Felony with No Priors: A nondangerous Class 4 felony is punishable by up to three and three-fourths years in prison. A dangerous Class 4 felony is punishable by up to eight years in prison.
Class 3 Felony with No Priors: Up to eight and three-fourths years in prison; up to 15 years in prison for a dangerous Class 6 felony.
Class 2 Felony with No Priors: Up to 12.5 years in prison; up to 21 years in prison for a dangerous Class 6 felony.
- Class 1 felonies have serious consequences and should be discussed with an attorney. Homicide (murder) cases are classified as Class 1 felonies.
- If you have prior convictions on your criminal record, the punishments for these classifications of felonies become more severe.
